The statute of limitations in Alabama
is the period of time in which a lawsuit must be filed or other notice
given. As a general rule for
adults injured, and there are exceptions, an action for medical
malpractice
must be commenced within two years of
the date of the act giving rise to the injury or within six months of
the date that the injury should have been discovered.
Generally a personal injury lawsuit must be filed within two
years from the date of the injury but if the injury is to a minor than
the statute of limitations starts to run on the minor’s nineteenth
birthday except in cases of medical malpractice or wrongful death.
A wrongful death action must be commenced within two years.
